You are welcome to copy some files, but follow the instructions given below.
We are dealing, in the Classical Music Archives (CMA), with four sets of copyrights:
- The copyrights of the Archives as a whole. This belongs to Classical Archives, LLC (CALLC)
- The copyrights of the performances. These belong to their respective performer(s) or producer(s)
- The copyrights of the media files. These belong to their individual contributor or to CALLC when encoded here
- The copyrights (if any) of the work (the score or composition) performed in the media file.
These belong to the composer, his/her publisher, estate, or other appropriate copyright holder.
As a rule, the compositions represented in the CMA are now in the
public domain (composed before 1923)
or the contributor of a performance of a non-public domain composition must have
received the express permission to make the media file from the appropriate copyright holder.
Otherwise the media file is not allowed in the CMA. (By submitting a media file to the CMA,
each contributor undertakes that the composition is either in the
public domain (composed before 1923)
or that he or she has received the express permission for its copyright holder
to perform the work and submit it to the CMA.)
PLEASE NOTE THAT ALTHOUGH A COMPOSITION MAY BE IN THE PUBLIC DOMAIN,
THE MEDIA FILE IN WHICH THE COMPOSITION IS PERFORMED IS *NOT* IN THE PUBLIC DOMAIN.
Individual Subscribers can access 1,000 files/month
Free users are very welcome but are limited to 5 files/day.

File access limits:
- Free users: 5 files/day(1)
- Individual Subscribers: 1,000 files/month and 100/day(2)
- Schools/Libraries: 1,000 files/month within the approved IP-range, and 500/month outside the range. Both are subject to 100/day/pc(2)
Unless you are a subscriber you may only listen up to 5 unprotected(1) files per day.
If and when you reach a limit, further access is denied for that day and you will receive a message
asking you to come back the next day (after Midnight GMT/UTC) - or to subscribe.
(1)Unprotected files (WMA streams, MIDI files, and Free audio files)
(2)Subscribers may access (download, stream, listen to) all files, unprotected files (MIDI files and WMA streams)
and protected files (HiFi MP3, ZIP files, and One-Click TicketsSM)

ACCELERATORS, ROBOTS AND DEEP-LINKING
|
Never download more than two files at the same time. Most browsers can't cope with more than two simultaneous downloads.
The CMA doesn't accept download/browser-accelerators, off-line browsers, or other copying-robots.
Some accelerators are not compatible with the CMA and cannot perform any download.
Others may be barred from the CMA as indicated below.
The term "accelerator" includes robots used to automatically copy the contents of a web site,
download/browser accelerators, and off-line browsers.
These programs
- put an incredible strain on web servers and often cause them to crash!
- eat up enormous amounts of bandwidth
- stop other visitors from accessing the site
- can blatantly violate copyrights
- are not allowed by the CMA unless they are from well-behaved and recognized search engines
Accesses from a suspected robot may be barred for one day or even, in some case, permanently.
Deep-linking is not permitted.
Some people (bandwidth pirates) try to link to the media files on our servers from their web page or emails. This is called "deep-linking."
Some users do that for their background sound - using the BGSOUND or EMBED tag.
Deep-linking to our contents cannot work as we constantly change the path to our media files.

All users are limited by their respective daily and/or monthly limits of accesses.

The Archives also offer Zip Collections to subscribers for download. These zipped files
contain the MIDI files (only) that are below the Zip Collection button:
The restriction in use of our files as described here also apply to the Zip Collections and the files they contain.
In particular, these files are for the subscribers' personal use only and may not be shared with any third party, placed in
a website or email, or used for any commercial purpose whatsoever (see this for commercial uses.) The notice in the index.html pages in
the Zip Collections cannot be removed from these pages without voiding the license.
HOW TO USE CMA FILES ON YOUR NON-COMMERCIAL WEB SITE
(See below for a commercial venture, CD-ROM, DVD, website, or film/video.)

DO NOT LINK (DEEP-LINK) TO ANY MEDIA FILE ON OUR SERVERS FROM YOUR PAGE OR YOUR EMAIL!
We often change the location of our files (paths) so your links won't work for long. Also, the servers
refuse link-requests from other sites (bad referers).
INSTEAD, YOU MAY COPY UP TO 10 (NON-STREAMED) MEDIA FILES TO YOUR WEB SITE'S SERVER
BUT YOU MUST ASK FOR PERMISSION
from each file contributor (who may or may not provide it.)
If you do receive permission, you must COPY THE FILE(s) TO YOUR SERVER
and provide the notice given below.
Note that I am happy to give you permission, right here and now, to copy my own

If you want to use one of our files (using either one of the HREF, BGSOUND or EMBED tags),
you MUST instead copy that file to YOUR server after obtaining permission.
You have the permission to copy my own
files. These are marked with (*). Remember to use the notice given below.
But to copy another file, you must contact its contributor whose email
address is hopefully in this page.

CMA FILES IN COMMERCIAL VENTURE, WEBSITE, CD-ROM, DVD, FILM/VIDEO, ETC.

If you wish to use files in a commercial website or venture, a CD-ROM, DVD, or film/video, I can (and do) give permission for my own files. (These are also marked with an asterisk (*) in the CMA.)
Permission to copy any of the others must be obtained from each of their respective contributor (who may or may not provide it.)
Remember that even though a composition may be in the public domain, the performance and the file are still copyrighted.
A maximum of 20 files copied from the CMA may be used for commercial website or venture, a CD-ROM, DVD, or film/video.
In addition you may not contact our contributors en masse. Their email addresses
(as available in our list) are provided only for requesting
the permissions for these 20 files. You must contact each contributor
separately (not through spamming) and contact no more than 5 contributors per month.
